"Seller" or "Home Seller" means a person who is selling or considering the sale of a property. "Client" is a User that has completed the registration process and has agreed to these Terms of Use. "Site" means the HomeZill Internet website currently located at the URL address www.homezill.com. DISCLAIMER Commission credits or refunds assume that the listing broker (seller) or builder/developer (seller) is paying a 3% buyer''s side brokerage commission. Credits to be reduced or adjusted accordingly if seller pays less than 3%. (Example: credits reduced ½% if seller pays 2.5%). Buyer(s) should be pre-approved by a lender with a pre-approval letter prior to viewing homes. Buyer will need to have a signed Remax choice buyer broker agreement for our credits to apply. If purchaser is obtaining new financing, purchaser should notify lender about broker credit at loan application. Broker intends to disclose broker credit on HUD-1 settlement statement. Credit could also be in form of reduced purchase price (if buyer and seller both agree) or utilized to buy down your interest rate so your monthly payments are lowered (check with your lender or your realtor). Resale credit program is for resale properties in our service area in Northern Virginia, Maryland, and Washington D.C. In other areas, contact us if you would like us to refer you to an independent broker in that area. Credits in other states are subject to referral availability as well as state law requirements. NOTE: All credits from HomeZill to clients are subject to your lender''s approval. HomeZill will work hand in hand with your lender to make sure this happens, but it is not guaranteed. If either party employs attorneys to enforce any right in connection with any dispute or lawsuit, the prevailing party shall be entitled to recover any reasonable attorneys' fees.
